These Terms of Service (“Terms”) govern your use of metrohousingcollaborative.com, our online forms, our partner and property search portal and the communications we send (together, the “Services”), which are operated by Metro Housing Collaborative (“MHC”, “we”, “us”), a nonprofit organization in Omaha, Nebraska. By using the Services you agree to these Terms and to our Privacy Policy.
Who may use the Services
The property search portal and partner tools are for approved property partners, community partners and their authorized staff. You must be at least 18 years old and provide accurate information when you sign up. If you register on behalf of an organization, you confirm that you are authorized to act for it.
Accounts and sign-in
Access to the partner portal is tied to the email address on file with MHC. Keep your sign-in codes and devices secure and do not share your access with others. Tell us right away at info@metrohousingcollaborative.com if you believe your access has been used without permission. We may suspend or remove access at any time to protect the Services, our partners or the people we serve.
Program terms
- Rental incentives, Risk Mitigation Fund payments and other program benefits are subject to separate written agreements, program rules and the availability of funding. Nothing on the website guarantees a payment or a placement.
- Property partners are responsible for keeping their listings accurate and current, and for complying with the Fair Housing Act, Nebraska and local housing law and their own lease terms. Property partners make their own decisions about offering a lease.
- Community partners confirm that they have the proper authorization, including any required release of information, before submitting referral or pre-application details about the people they serve, and that they will use information from the Services only to assist those individuals.
- We may change, pause or end any program or feature at any time.
Text messaging terms
Metro Housing Collaborative offers text messaging to its property partners, community partners and others who opt in. By checking the consent box on one of our forms, or by texting our number first, you agree to receive text messages from MHC at the phone number you provided.
- Message types: updates about rental listings, pre-applications and housing searches, document and signature requests, incentive and fund request status, orientation and appointment reminders and replies to your questions. If you separately opt in, we may also send occasional program news and event invitations.
- Message frequency varies depending on your activity with us.
- Message and data rates may apply. Check with your mobile carrier for details about your plan.
- To stop receiving text messages, reply STOP to any message. You will receive one final message confirming that you have opted out. To get help, reply HELP, email info@metrohousingcollaborative.com or call (402) 409-1212.
- Consent to receive text messages is not a condition of becoming a partner or receiving any service from MHC.
- Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier’s network availability.
- Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for how we handle your information.
Acceptable use
You agree not to misuse the Services, including by submitting false information, accessing data you are not authorized to see, interfering with the operation of the Services, scraping or copying content for other purposes or using the Services to discriminate against anyone in violation of fair housing law.
Content and intellectual property
The website, portal, logos and materials are owned by MHC or its licensors and may not be copied or reused without permission, except for your own use in working with our programs. You keep ownership of the listing details, photos and documents you provide, and you give MHC permission to use them to operate the programs, including showing listings to approved partners.
Disclaimers
The Services are provided as is and as available. MHC does not guarantee that listings are accurate, that a unit is available, that a referral will result in housing or that the Services will be uninterrupted or error free. Information from partners is provided by those partners, and MHC does not verify every detail.
Limitation of liability
To the fullest extent permitted by law, MHC and its staff, board members, volunteers and service providers are not liable for any indirect, incidental, special or consequential damages, or for any loss arising from your use of the Services or from the actions of other partners or tenants. Nothing in these Terms limits liability that cannot be limited under applicable law.
Governing law
These Terms are governed by the laws of the State of Nebraska. Any dispute will be handled in the state or federal courts located in Douglas County, Nebraska.
Changes to these Terms
We may update these Terms from time to time. The effective date at the top shows when they were last revised, and continued use of the Services after a change means you accept the updated Terms.
